Still Not Discharged!!!

In March I went through mediation ( I hadn't made my surplus payments) and signed for a discharge conditional that I repay what I owed. Well, I was still working and made a couple of payments but then my excessive spending elsewhere left me without money for the payment and I haven't made any since and I just quit my job. What will happen if I don't pay up? Can my creditors come after me again? I'm afraid to answer the phone and I'm afraid to contact my trustee as he has tried to help me in the past but I have let him down. Any advice? I know I don't deserve sympathy but I'm really frenzied!! Thanks.

It depends on your trustee. You've likely signed a promise to pay a certain amount within a certain amount of time, and your mediation agreement likely included terms as to what would happen should you fail to do so. Each trustee can create their own agreement, so I don't know what the terms are in yours.

In a bankruptcy, the trustee has to hold on to most of the funds until they close the file before they get paid. Eventually, they may decide that they want to get paid and will close your file. As soon as they close their file AND you haven't gotten your discharge, your creditors can come after you again.

You're going to have to come to an agreement with your trustee sooner or later and pay the funds, otherwise you'll be where you started before you filed, AND you'll have paid (and owe) the trustee money.

It has been almost 6 months since I originally posted my original post with regards to not making my agreed upon mediation payments. I have not spoken to my trustee since and to my knowledge he has not tried to contact me regarding this matter. Am I correct in assuming that the next time I hear from him will be that he is discharging himself from my case? I have more or less gone into hiding, avoiding this issue, and trying to figure out some way to get back on track. Financially, I'm in dire straights. I have been working here and there just to keep up child support payments( I have never missed one payment),but I don't know how long my common-law will put up with my situation. It's an all around messy situation. I have been contemplating relocating across the country and trying a new start before the trustee pulls the pin on me. Anyone out there agree? Thanks.

running won't solve anything
I would try to reach your trustee and talk to them

running will make things worse - talk things out and figure a way out of this mess now before it gets worse
