Supplementary credit cards and consumer proposal

So I've been to a local trustee and was getting all the paperwork in order to file for a proposal.  After my appointment we get home and my husband's new credit card (he's not filing a proposal) came in (which he applied for 2 months ago. Pre-proposal) and they issued me a supplementary card.   They did not run my credit I am in no way liable for this card it is literally an extra card he's giving me permission to use.   Before activating I called the trustee to ask what to do with it and if I can keep it since it's not my credit.  She then says I must surrender it and all cards which have my name on them by law I cannot have any credit at all. Fine.  I'm not sure I believe what she is telling me. I've called the credit card company just to ask if I were allowed )if my credit was checked/if I could still have a supplementary card on his account after cp/bankruptcy they said yes bc it's his credit just an extra card to use.  I tell the trustee this and she states" that's all just here say and they are only saying this to get u to use it and are lying".  Why would the credit card company lie? I explained I am not secondary on the card my credit is not on it at all and I am in no way liable and she still insisted that I was wrong and I cannot have it and must surrender it to her with my other cards when I sign... Is any of this accurate? I've read before if I had a zero balance card I would be allowed to keep it (they may cancel but I could keep it if they don't cancel it) so why would that be allowed but a supplementary card that I am in no way liable for not allowed??  Anyone have any insight? thoughts? Opinions?   I should also add that I'm in this mess bc of unusual circumstances that were use credit or literally starve.  I did not just go max out any card  because I felt like it.. (but I feel ask if she's treating me this way)

It seems like it would be best if you go see a different trustee and see what their opinions are on this supplementary card matter. If it makes you feel better, I agree with you and think you should be allowed to keep your supplementary card.

From what I could find.....

The answer lies in the specific terms and conditions of the credit card itself.  Each credit card is different.



And......


When somone files for a bankruptcy or a consumer proposal they are required to deliver to the trustee, for cancellation, all credit cards issued to him/her and in his/her possession or control.

The only exception is for those cards where the credit card was issued to a third party (e.g., employer, spouse, friend, parent) and the trustee has confirmation that the issuer (i.e. the credit card company) or the third party has authorized the bankrupt to continue to possess and use the card.

What is the difference between a supplementary card and a secondary card holder?
A supplementary card is issued where a card holder wishes to allocate a portion of their card limit to another. A supplementary card holder is not responsible for the account.
A secondary card is issued where the secondary card holder is able to use the account and is also responsible for the account. However, some credit card companies use different terms and definitions it is important to have these terms defined by your bank or credit card company before you choose which type of card is best for you
