What I a roller coaster, I don't know that my heart can take this much stress. The Trustee's office and the original girl I was working with calculated things wrong even though I was very adamant at asking you are sure this is right....turns out the lowest they can do a proposal for is $550. Its a $100 more than I was planning, still a bit less then the other office but still its like serioulsy can you not stress me out more! they say they can submit it and its a bit iffy but think it should get accepted and if not they will come back with a counter. So I guess I have to take the chance and hope that someone is on my side and accepts this or I maybe have to decline this option as if they give a payment I cannot afford I am just going to end up Bankrupt trying to pay it. ugh I know I got myself in this mess but I really wish that I could get a break for once and have a fighting chance to get myself back on track. :-\

Did anyone else have to pay their first payment (non refundable) when they signed the papers before the proposal was accepted? I am starting to wonder if this is fishy that they could submit a proposal that they know will not get accepted but telling me it should and then keeping the money as "thier fees"

Hey Blondie,

Sorry to hear about the problems you are encountering.  I know, this can be very stressful, I'm still waiting to hear back and just hoping everyday... 

Just to let you know, I too had to provide an initial payment the day I filed.  I kind of assumed I would get it back if the proposal was not accepted, but honestly I am not sure...  The way I thought it worked was that the trustee only gets paid if they are able to get your creditors to accept a proposal.

So, have you filed or are you still considering?

I asked around a few other trustees and I guess that is the norm, you make the first payment and its non refundable if the proposal doesn't end up accepted.
I will be signing documents tomorrow and then the painful wait starts I guess....

long story short went to sign papers today but turns out my car is not secured to the loan as we thought....i thought I was out of luck but in all honesty didn't really like how i was being treated at the second place so started emailing with the first place again this morning and it turns out we can include the loan and i might be in an even better position then in the begining, getting rid of a loan of 932 a month and signing a proposal for a total of $825!! fingers and toes crossed this is right, back to the first place on monday, please positive thoughts for me, I am so stressed!

I'm sure anybody that has filed paid up front. I know I did and don't regret it. The waiting to see if it's accepted is the hardest thing but I thinks it's something like 99% approval rate so don't sweat it too much. :)

Also another question once you file a cp and it gets accepted they don't put a lien on any assets right so in a couple years I could sell my car if I wanted right?

As long as the loan is paid off on the car or if there isn't one at all, you can sell it anytime. If you sold it and there was a loan, the bank would want the loan paid off as there is no collateral. No liens are put on after a CP.

perfect thanks again! I had a fitful sleep last night but I am feeling a bit better about things. Feeling good that I am switching back to the original trustee as they seem to know what they are doing more and they are right across the street from my work so I can just pop over and unlike the other one they have automatic debit for payments so I do need to worry about post dated cheques etc. I do all my banking online and this will just be so much more convenient and no excuses to ever miss a payment.
Monday seems just a long wait but i guess I have to gear up for a 45 day wait after that, but the more I read the more it seems that it is a very low percentage of cp's that don't get accepted as long as they are showing they would get more in a cp than a bankruptcy so i think it should be good. FINGERS AND TOES CROSSED!
