Excess Income Payments
« on: December 07, 2010, 06:38:21 PM »
I filed for bankruptcy in August of 2007.  I was required to pay the first 9 months @ $180/month i think it was, then i was required to pay $ 280.00/month for another year.  I was going through a divorce during that time.  When i submitted my expense sheets in April of 2008 for the excess income amount to be calculated at $280/month; my expenses then became higher as of July 1, 2008, as i had moved, higher rent, utilities not included, had to get a car (my parents loan that i am paying currently) etc.  I managed to start paying my $280/month as of August or September 2008. then would pay an extra 140$ on months with 3 pays to catch up.  Then in June of 2009, went to court, my ex-husband and my lawyer met with bankruptcy trustee prior to divorce hearing (i was not included in this meeting) to apparently discuss a deal with my share of the home equity and my bankruptcy.  I was then ordered to start paying child support of $240.00 month, needless to say, i am still 3 payments short of my discharge.  My bankruptcy trustee, prior to divorce hearing, stated that i would be automatically discharged once i had to pay child support, or when the marital property matter was dealt with.

It's december 2010, still no discharge, i was contacted recently, over one year after divorce, that the property matter still was not settled and she felt that it was proper that i needed to sign over the marital property to ex-husband, along with the trustee's signature and she felt (real estate lawyer she is) that once this matter was done, that i should get my discharge.   (she believed that he had to pay to trustee, around 20,000$)

After this, on top of paying, nearly 6000$ to trustee myself, do i still have to pay the nearly 800$ that is still missing to get my discharge?  Was there a point where my living circumstances and expense circumstances changed, that would have affected my income surplus payments?

thanks for your reply.

Try to make an arrangement with the trustee, they would  likely delay your discharge if you don't pay them the monthly fees.
