Date of Last activity changes after bankruptcy :(
« on: November 08, 2014, 04:23:55 PM »
Hey All,

So I've been discharged since 2010 and originally applied for bankruptcy in 2008.  Due to a delay caused by the courts, it took a while to get it all settled.  But that's not important... I've now been free for 4 years! It's been pretty great....

So my credit scores are on the rise and have been attaining decent levels.  I check them every month and i am used to the dips/rises that they go through.

Here's the issue though:
I had a date of last activity for my last bad account drop off because the date of last activity past 6 years.  My score shot up!  IT was great.... then a few month later, it came back with a new date of activity in 2009.  How come it can change?  My score dropped as a result of course... and by a lot!

So:  Are they supposed to keep changing the date of last activity like this?  Is there supposed to be any activity on the account after I file for bankruptcy?  I called the company and they said that they didn't have to recognize anything until my discharge which was in 2010 and so once my 2009 drops off, they will simply re-add it to 2010 instead.

Is this normal and is there anything I can do?  Equifax and Transunion state that date of last activity isn't within their control to ask for a correction....

Any thoughts?

The date of last activity, as I understand it, is the last time there was any general activity on an account, including payment or acknowledgement of the debt. I'm not an expert on this subject, by any means.

If you included this creditor in your bankruptcy (which you are required to do), they would have received a dividend in your bankruptcy, or failing that, a notice that your bankruptcy was finishing. That would have around 2010, so I'm wondering if this is the date that the creditor used.

I don't have a sense of how normal this is, but the term "Date of Last Activity" seems pretty fluid, so I'm guessing different creditors interpret it differently. I don't know if there's anything you can do about it for that very reason.
