Before discharge and after
« on: May 17, 2014, 10:38:47 AM »
Hi,

Me and my wife went into bankruptcy almost 3 years ago and we are scheduled to be discharged next month ... my question is ... all the money we have given to our trustee in past few years will we see any of that back if there is more than needed to pay off the creditors.

It is possible, but that's an unsual and unlikely scenario. If zero creditors submit a claim, for example, but you have surplus income, then you would pay the standard trustee fees and money could be refunded. Beyond the trustee's fees, there are other costs that would offset against any money that you paid. For example, some legal expenses can come out of the estate, not your trustee's pocket.

If you are in this scenario, why didn't you do an in-bankruptcy proposal? Your bankruptcy gets anulled - it dissapears completely - and your creditors get the same amount of money.
